How To Prepare
Below are a few helpful tips.

Turn Off Sprinklers
- Please do not do any watering in the yard the night before the work is scheduled and DO NOT water again until the day after work is finished.
Remove All Vehicles - The street / parking lot will be closed the day of sealing starting at 7:00am and will remain closed until 7:00am the next morning. The seal needs 24 hours to dry.
Park Outside Of Project Area - Please plan on parking outside the area that will be treated if you need access to your vehicle.
Avoid Walking or Driving On Fresh Seal - If you travel on the fresh seal, you will be financially responsible for any damages to surface and tracking the seal onto the driveway.
Towing at Your Expense - If it is a street that is going to be sealed, we will have a tow truck on call to move any car that does not honor the work-day. The cost to move the car to another area of the community will be charged to the owner of the vehicle. The crews must have complete clear and free access for the work to be completed.

Contract Terms
Proposal & Agreement: We propose to furnish all necessary labor, material, equipment, and insurance to complete the following operations in a first class workmanlike manner. Any alteration or deviation from the following specifications involving extra cost will be executed only upon an approved change order and will become an extra charge over and above the following stated price.
Insurance: Upon request, Contractor agrees to deliver a certificate of Workmen’s Compensation insurance and a certificate of liability and property damage insurance. If requested, the inclusion of additional insured, on our policy shall be an additional $200.00 to $400.00.
Warranty: Unless otherwise noted, Contractor guarantees all installed labor and material for a period of one (1) year from the date of completion. This contract does not guarantee the following: adhesion to petroleum saturated areas, power steering marks or tire marks made on the seal after application, skin patching overlays, patching and repair of existing asphalt, grading or water flow, base or sub-base, crack filling over pre-existing crack sealant from previous contractor. Any repairs affected by these conditions will be billed to the owner. Guarantee does not apply to acts of war, tornadoes, earthquakes, circumstances beyond Contractor’s control, or unnatural acts; nor does it include incidental or consequential damages. The owner must carry fire, tornado, and other necessary insurance on the above work. Asphalt Protectors Inc. bid limit is $300,000.00.
Temporary facilities: Owner shall provide electricity, water, and toilets for the use of the Contractor on long-term jobs. There will be no unnecessary use of these utilities.
Payments: A 50% deposit is due one week prior to work commencing and final payment is due on date of completion. If deposit is not received, Asphalt Protectors, Inc. reserves the right to reschedule project according to availability.
Late Charge on Delinquent Payments: Should the owner fail to pay when due as agreed to herein, or fail to pay for any change, alteration or extra before commencement of the work as provided herein, or fail to pay the final payment upon completion of the work all said delinquent payments or any unpaid portion thereof, shall be subject to a late charge calculated at the rate of one and two (2) percent per month until paid, and the owner agrees to pay said late charge to Asphalt Protectors, Inc. A lien release will be provided upon request but there will be an administration charge of $35.00 for the lien to be notarized.
Attorneys fees and costs: In the event it becomes necessary for contractor to retain an attorney as a result of any dispute or failure to pay the amounts owed to contractor, owner shall pay, in addition to all other amounts owed to contractor, contractors reasonable fees and costs, including but not limited to attorneys fees and costs incurred as a result of any litigation.
Changes, Alterations, and Extras: All changes to the initial contract proposal will be stated in a Change Order Proposal. Any deviation from the above specifications involving extra costs, will be executed only upon written orders, and will become an extra charge over and above the estimate. Should the asphalt materials prices increase after the time this bid has been provided, the estimate will increase to the actual price of the asphalt.
Towing: All vehicles not removed from premises on the scheduled work date must be towed by the property management company/owner at the vehicle owner’s expense. It is the responsibility of the owner/property manager to have all vehicles removed from said property for Asphalt Protectors, Inc. to perform their contract. Should Asphalt Protectors, Inc. have to return to jobsite at another time to complete the work due to unmoved vehicles/debris, there will be an additional charge of $600 setup fee.
Sprinkler system: All sprinkler systems must be shut off the night before the work is scheduled. If the asphalt is wet, Asphalt Protectors, Inc. will be forced to delay the project and an additional fee will be assessed to cover preparation costs. Upon job completion, all sprinklers can be turned back on the following day.
Fuel Surcharge: Due to fluctuating fuel increases, this contract can be subject to a 3% fuel surcharge.
